1. General Provisions

1.1. The website gendump.ru and the software product Dump Generator (hereinafter — Gendump) offers the User to use the Gendump service available at https://gendump.ru/ or locally on the User's computer (hereinafter — the Service).

1.2. By beginning to use the Service or its individual functions, the User confirms that they have carefully read these Terms and accept them in full without reservations, and also accept the terms of all documents referred to in clause 1.2. In case of disagreement, the User must immediately stop using the Service.

1.3. Gendump has the right to unilaterally amend the Terms. The new edition comes into force from the moment of publication at https://gendump.ru/terms, unless otherwise expressly provided by the new edition.

1.4. In case of disagreement with the changes, the User is obliged to stop using the Service. Continued use means acceptance of the new edition.

1.5. The Service provides the User with the technical ability to process (modify) files belonging to them. All existing functions, as well as their development or the addition of new ones, constitute the subject of these Terms.

2. Use of the Service

2.1. The User warrants that they possess all legal rights to the uploaded files and their modification, including but not limited to copyright and related rights.

2.2. The User agrees that the files uploaded by them may be accessible to Gendump developers solely for the purposes of supporting and developing the Service.

2.3. The User assumes all risks associated with the use of the Service and waives any claims against Gendump to the extent permitted by applicable law.

2.4. Gendump has the right, without prior notice, to modify file metadata (name, description, labels) for the correct operation of the Service.

2.5. In case of violation of these Terms or the law, Gendump may restrict or terminate the User's access to the Service without a refund.

2.6. The User undertakes to use the received files exclusively for informational purposes, in accordance with the legislation of their country of residence, and bears full responsibility for any other use.

2.7. The Service does not control and is not responsible for the User's use of files, including possible damage to equipment, software, or the legality of the application of the files.

2.8. Gendump has the right to inform the User about updates and news of the Service using the provided contact details.

2.9. The User confirms that any software products created using the Service are intended solely for use on closed tracks or competitions and are not intended for public roads.

2.10. Gendump has the priority right to independently remedy the identified problems under the Processing Task. The User must wait for the problem to be remedied or for a message that it cannot be remedied.

2.11. The presence or absence of specific options depends on the firmware and may not match the description; such a discrepancy in itself is not considered a deficiency of the service.

2.12. File Catalog (Internal Database)

2.12.1. In the Service, the User may be given the opportunity to obtain files from the catalog (internal database) of the Service (hereinafter — "Catalog Files") without uploading their own source file.

2.12.2. Catalog Files are formed from various sources, including, but not limited to, files provided by Users/partners and/or obtained from other legal sources. In this regard, the Service may not have complete and reliable information about:

  • the method and equipment of the primary reading of the file;
  • the completeness of the dump (full dump/partial dump/calibration area, etc.);
  • exact applicability to a specific ECU/hardware revision/software version;
  • the immutability of the file relative to the factory state (changes previously made by third parties before the file entered the catalog are possible).

2.12.3. The information displayed in the card/description of a Catalog File (software number, labels, description, compatibility, "FULL/calibrations", etc.) is for reference purposes and is provided "as is", based on the data available to the Service. The Service has the right to clarify/correct such metadata (clause 2.4 of the Terms).

2.13. File Completeness and Compatibility with Writing Equipment

2.13.1. The User understands and agrees that not all Catalog Files are full dumps. A Catalog File may contain only part of the data (for example, calibration areas) and/or be suitable only for writing in modes/tools that support partial writing of the corresponding areas.

2.13.2. Unless expressly indicated for a Catalog File that it is a "FULL/full dump", the Service does not guarantee that this file is a full dump and/or will be written by any equipment/software in the standard "write entirely" mode.

2.13.3. The Service does not guarantee the compatibility of Catalog Files with specific programmers/flashers, their versions, licenses, writing modes, or the correctness of writing to a specific instance of the User's equipment. The obligation to verify applicability (including the choice of writing mode and a suitable tool) lies with the User.

2.13.4. To guarantee obtaining a source file suitable for restoring a specific vehicle/ECU, the Service recommends that the User use their own file read from this ECU and uploaded by the User to the Service.

2.14. Remedy of Non-conformities, Replacement of Result and Refunds

2.14.1. If the User identifies a discrepancy of the Catalog File with the parameters stated in the card (for example, a different software number / clearly incorrect identification), the User is obliged to send a request to support with a description and supporting data. The Service has the right to request additional information necessary for verification (ECU identifiers, read original, screenshots/logs of reading/writing, etc.).

2.14.2. In accordance with clause 2.10 of the Terms, the Service has the priority right to propose a solution to the problem, including providing an alternative file from the catalog, correcting metadata, reprocessing, or a message about the impossibility of remedying.

2.14.3. The issue of refunding funds is considered by the Service individually, taking into account the nature of the discrepancy and applicable mandatory legal norms. In particular, it is not a deficiency of the service/result in itself that the Catalog File turned out to be partial (for example, contains only calibrations) and/or is not written by the specific equipment of the User in the absence of a direct promise of compatibility/completeness in the file card.

3. Warranties and Liability

3.1. The Service and its results are provided "as is" (AS IS). Gendump does not provide any direct or implied warranties, including fitness for a particular purpose, continuity and error-free operation, to the extent permitted by law.

3.2. The maximum liability of Gendump for any Task is limited to the lesser of two values: (a) the actually paid cost of the Task or (b) 10,000 (ten thousand) rubles, unless otherwise provided by mandatory legal norms.

3.3. Gendump under no circumstances shall be liable for indirect/consequential damages (lost profits, data loss, reputational damage, equipment damage), as well as for claims of third parties arising from the use or inability to use the Service.

3.4. The User undertakes to settle at their own expense and by their own efforts any claims of third parties related to the files or their processing, and to indemnify and hold Gendump harmless, reimbursing documented losses and expenses, including the costs of legal services.

3.5. The limitations of liability specified in this section apply unless the damage was caused by the fault of Gendump intentionally or through gross negligence, in accordance with Art. 401 of the Civil Code of the Russian Federation.

3.6. Gendump is released from liability for partial/full non-fulfillment of obligations caused by force majeure circumstances (force majeure): natural disasters, military actions, acts/prohibitions of authorities, power outages, provider failures, etc.

4. Dispute Resolution Procedure

4.1. Claims are accepted in writing at mail@gendump.ru with a description of the circumstances. The response time is 10 calendar days.

4.2. If no agreement is reached, the dispute shall be considered in court at the place of registration of Gendump. This clause does not limit the rights of the consumer granted by mandatory norms.

4.3. The law of the country of registration of Gendump applies to these Terms, except in cases where the mandatory norms of the state of residence of the consumer provide otherwise.

4.4. Before going to court, the parties undertake to undergo the mandatory pre-trial procedure: send a claim and wait for a response or the expiration of the period under clause 4.1.

5. Final Provisions

5.1. The invalidity of any provision of the Terms does not affect the validity of the remaining provisions.

5.2. These Terms constitute the entire agreement between Gendump and the User and supersede all previous agreements.
